제2조 ①이 헌법에 의하여 통일주체국민회의에서 선거된 최초의 대통령의 임기는 이 헌법시행일로부터 개시된다.

②이 헌법에 의하여 선거된 최초의 통일주체국민회의 대의원의 임기는 통일주체국민회의의 최초의 집회일로부터 개시되고 1978년 6월 30일에 종료된다.

제3조 이 헌법에 의한 최초의 국회의원총선거는 이 헌법시행일로부터 6월이내에 실시한다.

제4조 1972년 10월 17일부터 이 헌법에 의한 국회의 최초의 집회일까지 비상국무 회의가 대행한 국회의 권한은 이 헌법시행당시의 헌법과 이 헌법에 의한 국회가 행한 것으로 본다.

제5조 이 헌법시행당시의 공무원과 정부가 임명한 기업체의 임원은 이 헌법에 의하여 임명된 것으로 본다. 다만, 이 헌법에 의하여 선임방법이나 임명권자가 변경된 공무원은 이 헌법에 의하여 후임자가 선임될 때까지 그 직무를 행하며, 이 경우 전임자인 공무원의 임기는 후임자가 선임되는 전일까지로 한다.

제6조 ①이 헌법시행당시의 법령과 조약은 이 헌법에 위배되지 아니하는 한 그 효력을 지속한다.

②이 헌법시행당시의 대통령령·국무원령과 각령은 이 헌법에 의한 대통령령으로 본다.

제7조 비상국무회의에서 제정한 법령과 이에 따라 행하여진 재판과 예산 기타 처분 등은 그 효력을 지속하며 이 헌법 기타의 이유로 제소하거나 이의를 할 수 없다.

제8조 이 헌법시행당시에 이 헌법에 의하여 새로 설치된 기관의 권한에 속하는 직무를 행하고 있는 기관은 이 헌법에 의하여 새로운 기관이 설치될 때까지 계속하여 그 직무를 행한다.

제9조 1972년 10월 17일부터 이 헌법시행일까지 대통령이 행한 특별선언과 이에 따른 비상조치에 대하여는 제소하거나 이의를 할 수 없다.

제10조 이 헌법에 의한 지방의회는 조국통일이 이루어질 때까지 구성하지 아니한다.

제11조 ①특수범죄처벌에관한특별법·부정선거관련자처벌법·정치활동정화법 및 부정축재처리법과 이에 관련되는 법률은 그 효력을 지속하며 이에 대하여 이의를 할 수 없다.
